The Public Commissioner within the legal time limit filed an appeal at the Appeal Chamber by the Constitutional Court against the Decision no. 521/2022, of the Independent Qualification Commission, for the assessee, Mr. Erjon Shehaj, prosecutor / head at the Prosecution Office of the First Instance Court, Lezhë
The Public Commissioner ascertains that, from the review of the decision no. 521/2022, of the Independent Qualification Commission and its accompanying acts, emerge legal findings and circumstances that do not meet the criteria and professional standards, which guarantee the protection and strengthening of the public trust, provided by law no. 96/2016, constituting in such way reasons to an overall assessment of the proceedings, according to the definitions of Article 4, point 2 of law no.84/2016.
The Public Commissioner requests that the appeal grounds be reviewed by the Appeal Chamber and, and pursuant to Article 66, point 1, letter “b”, of law no. 84/2016, at the end of the review of the case in the public hearing, to decide the amendment of the decision no. 521/2022, of the Independent Qualification Commission, and the dismissal from office of the assessee, Mr. Erjon Shehaj.
