The Public Commissioner within the legal time limit filed an appeal at the Appeal Chamber by the Constitutional Court against Decision no. 600/2022, of the Independent Qualification Commission, for the assessee, Mr. Robert Kote, prosecutor of Tirana District Prosecution Office.
The Public Commissioner based on his constitutional and legal competence finds that upon the review of the decision no. 600/2022, of the Independent Qualification Commission, and its accompanying acts, emerge such legal circumstances and facts wherefrom considers that this decision is vulnerable in its entirety, hence the conclusions reached by the Commission are not in compliance with the administrated evidence.
Based on the conditions provided in the acts, the Public Commissioner determines that the assessee does not achieve a trustable level for his confirmation in office, therefore, requests that the appeal grounds be reviewed by the Appeal Chamber and after the Chamber conducts a complete investigation, to decide the amendment of the decision no. 600/2022, of the Independent Qualification Commission, and the dismissal from office of the assessee, Mr. Robert Kote.
