The Public Commissioner was present today at the Appeal Chamber while initiating the judicial review of the appeal filed against Decision no. 535/2022, of the Independent Qualification Commission, for the assessee, Mr. Bledar Bejko, prosecutor at the Durrës District Prosecution Office.
After verifying the parties’ presence in the hearing, the presiding judge communicated that the parties have lodged their submissions to the Chamber to then continue the presentation process of the claims in the hearing session.
The Public Commissioner, embracing all the appeal grounds expressed that the deficiencies found in the three assessment criteria and the reckless behavior of the assessee in relation to third parties lead to the conclusion that the assessee does not achieve a trustable level to the confirmation in duty. At the end of the submissions, the Public Commissioner requested the amendment of the decision no. 535/2022, of the Independent Qualification Commission, and the dismissal from office of the assessee, Mr. Bledar Bejko.
During his submissions the assessee objected to the grounds of the Public Commissioner’s appeal, claiming that they are not based upon the facts. He also objected to the raising of claims in the public denunciations, which were mainly related to the control of the background and proficiency assessment criteria.
At the request of the presiding judge, the Public Commissioner stated her stance concerning the public denunciations considering their verification unnecessary since considered the appeal grounds to be sufficient.
In the following, the presiding judge addressed some questions to the assessee related to public denunciations, who sought to be provided time to prepare his stance.
The adjudication panel, with an interim decision, decided to open the judicial investigation and to administer in the quality of evidence the acts lodged in the hearing by the assessee and to provide time to the assessee to prepare his stance concerning the denunciations, therefore was decided to adjourn the following hearing session on May 17, 2023, at 11:00. a.m.
