The Public Commissioner was present today at the Appeal Chamber continuing the judicial review of the appeal filed against Decision no. 621/2023, of the Independent Qualification Commission, for the assessee, Mr. Erarbër Madhi, judge at Administrative Court of First Instance, Tirana.
The presiding judge during the verification of the parties’ presence in the hearing informed that the Public Commissioner Mrs. Irena Nino, the appellant, due to objective grounds was impossible to be present in the hearing thus the institution would also be represented in the present hearing by the Public Commissioner Mr. Florian Ballhysa.
In the final conclusions, the Public Commissioner stood to the grounds presented in the appeal, based on the IMO’s recommendation, which are related to the asset assessment criterion, eventually requesting the amendment of the IQC’s decision and the dismissal from the office of the assessee.
The legal representative of the assessee claimed the opposite of the Public Commissioner’s arguments, requesting the Chamber to uphold the decision of the Independent Qualification Commission, related to the confirmation in office.
After hearing the final conclusions the adjudication panel withdrew to the consultation chamber to take the final decision, to be announced on July 27, 2023, at 13:00 p.m.
