The Public Commissioner was present today at the Appeal Chamber continuing the judicial review of the appeal filed against Decision no. 318/2020, issued by the Independent Qualification Commission, for the assessee, Mr. Kujtim Luli, who holds the position of prosecutor at the General Prosecution Office.

Following the verification of the parties’ attendance in the hearing, the presiding judge invited the litigants to present the final conclusions.

The Public Commissioner, at the end of the judicial review, after a comprehensive examination of all explanations, objections, and evidence presented by the assessee also administered by the Appeal Chamber, has determined that, upon an overall assessment of the three established criteria, various deficiencies have been found in the asset assessment criterion. Consequently, this indicates that the application of Article 59 of Law no. 84/2016, in this present case is not grounded. As a result, the Public Commissioner requested to the Appeal Chamber the amendment of decision no. 318/ 2020, of the Independent Qualification Commission, and the dismissal from office of the assessee Mr. Kujtim Luli.

The assessee, on his part, requested the panel to provide time to revise his conclusions, claiming that the Public Commissioner’s final conclusions exceeded what he had anticipated in terms of counterarguments.

Following deliberation in the consultation chamber, the adjudicating panel decided to enable the assessee an additional 30 minutes concerning his claims.

Sustaining to the appeal grounds presented in the preceding hearing, the assessee objected to the findings made by the Public Commissioner during the final conclusions and requested the panel his reconfirmation in office.

Subsequently, the adjudication panel closed the judicial review and withdrew to the consultation chamber to make the final decision, which will be announced on October 6, 2023, at 10:00.a.m
