The Public Commissioner was present today at the Appeal Chamber to initiate the judicial review of the appeal filed against Decision no 442/2021, of the Independent Qualification Commission. This decision pertains to the assessee, Mr. Juljan Çafka , who holds the position of prosecutor in the Gjirokastra District Prosecution Office.
After the verification of attendance of the parties in the hearing, the presiding judge announced that today several new denunciations were filed at the Appeal Chamber, of which the adjudication panel was not yet acquainted with their content.
The hearing then continued with the submissions of the appeal grounds by the Public Commissioner.
The Public Commissioner, stood to all the appeal grounds based on a public denounce which refers to issues that were not previously investigated by the Independent Qualification Commission. Therefore, the Public Commissioner requested the Appeal Chamber to open an investigation and accept the relevant evidence in line with the appeal inquiry.
The assessee opposed the appeal referring to some decisions of the Appeal Chamber and requested the panel his confirmation in office.
With an interim decision, the adjudication panel opted to initiate the judicial review and requested the Prosecution Office of the First Instance Court of Tirana General Jurisdiction, Gjirokastër, the administration of the files about the cases referred to in the appeal.
The upcoming hearing is set to be held on January 26, 2024, at 9:00 a.m., where the parties shall also prepare their positions related to the denunciations recently filed at the Appeal Chamber.
