The Public Commissioner was present today at the Appeal Chamber where continued the judicial review of the appeal filed against the Decision no. 606/2022, of the Independent Qualification Commission, for the assessee, Mrs. Mariola Mërtiri, who holds the position of prosecutor at Tirana District Prosecution Office.
Following the verification of the parties’ attendance at the hearing, the presiding judge invited the Public Commissioner to present the final conclusions.
The Public Commissioner stood to all the appeal grounds, as well as the written submissions filed from the hearing of January 16, 2024, conducted within the context of this trial, found that the claims presented by the assessee failed to prove otherwise of the appeal grounds. At the end of the final discussions, the Public Commissioner requested the panel to amend the decision no. 606/ 2022, of the Independent Qualification Commission, and the dismissal from office of the assessee, Mrs. Mariola Mërtiri.
The assessee from her perspective, claimed that the Public Commissioner’s conclusions related to the appeal grounds and the comprehensive assessment of the case lacked support in facts and evidence and that is a misinterpretation of the law. In conclusion regarding her objections, the assessee requested that the Independent Qualification Commission’s decision be upheld for her confirmation in office.
The adjudication panel, once becoming acquainted with the final conclusions of the parties, closed the judicial review and deliberated in the consultation chamber to determine the final decision, which shall be announced on January 29, 2024, at 15:00.
