The Public Commissioner was present today at the Appeal Chamber to continue the judicial review of the appeal filed against Decision no 442/2021, of the Independent Qualification Commission. This decision pertains to the assessee, Mr. Juljan Çafka, who holds the position of prosecutor in the Gjirokastra District Prosecution Office.

After the verification of attendance of the parties in the hearing, the presiding judge announced that the documents requested by the Prosecution Office of the First Instance Court of Gjirokastra General Jurisdiction, were filed in the Chamber, whereof the Public Commissioner and the assessee had also become acquainted.

Subsequently, the adjudication panel decided the administration in the capacity of evidence, of the above-mentioned acts, and invited the parties to submit their stances.

The Public Commissioner presented his stance related to the acts aligned with the appeal grounds, and requested the Chamber, about the evidenced findings, to evaluate whether the assessee has undertaken full investigative actions in the cases he managed in the capacity of the prosecutor.

The assessee, in support of the claims that investigations had been concluded in each referenced case, submitted new documents, for which he requested to be administered as evidence and sought time to provide additional documents.

Following clarifications sought by the case rapporteur to the parties about their stances, the adjudication panel decided to adjourn the upcoming hearing on March 4, 2024, at 10:00. This adjournment is intended to afford the assessee ample time to provide the requested additional documents. Besides, if deemed appropriate for the assessee to submit in writing his opinion regarding the Public Commissioner’s submissions.
