The Public Commissioner within the legal time limit filed an appeal at the Appeal Chamber by the Constitutional Court against Decision no. 757/2024, of the Independent Qualification Commission, pertaining to the assessee, Mr. Erjon Shqarri, serving as a prosecutor in the Prosecution Office of the First Instance Court of Vlora General Jurisdiction.
Upon reviewing the decision no. 757/2024, of the Independent Qualification Commission, the Public Commissioner following the recommendation of the International Monitoring Operation (IMO), finds that the assessee failed to prove the opposite of the burden of proof over the findings that emerged from the administrative investigation.
The Public Commissioner requests that the grounds of the appeal be reviewed by the Appeal Chamber, and upon concluding a comprehensive assessment of the case, to decide the amendment of decision no. 757/2024, of the Independent Qualification Commission, and the suspension from duty of the assessee Mr. Erjon Shqarri, for a duration of one year and the obligation to follow a training programme according to the curricula approved by the School of Magistrates.
