The Head of the Special Prosecution Against Corruption and Organized Crime (SPAK), Mr. Altin Dumani, in exercising the powers of the Public Commissioner, was present today at the Appeal Chamber, to proceed with the judicial review of the appeal against decision no. 730/2024, issued by the Independent Qualification Commission (IQC), concerning the assessee, Mr. Valentin Preçi serving as a prosecutor at the Prosecution Office by the First Instance Court of General Jurisdiction of Tirana.

After verifying the parties’ attendance, the presiding judge invited the parties to present their final discussions.

The Head of the Special Prosecution Office, in line with the appeal grounds, the submissions, and the positions presented during the judicial review, also considering the Recommendation of the IMO, deemed that the assessee had inaccurately and insufficiently declared his assets and had failed to adequately declare the background control. Upon reviewing the evidence and the documentation provided, particularly in relation to the conflict of interest and issues arising from the examination of the denunciations, the Head of the Special Prosecution Office determined that the actions of the assessee violated the proficiency criteria according to the sub-indicators outlined in Law No. 96/2016, and that his professional conduct contradicted the core values and ethical standards expected of a magistrate. At the conclusion of the final discussions, the Head of the Special Prosecution Office requested that the Appeal Chamber amend Decision No. 730/2024 issued by the Independent Qualification Commission and dismiss from duty Mr. Valentin Preçi.

The legal representative of the assessee contested the points raised in the final discussions and requested that the Panel uphold the decision of the Independent Qualification Commission, thereby confirming the assessee’s continuation in office.

After reviewing the final discussions of the parties, the adjudicating panel retired to the deliberation chamber to make the final decision, which is set to be announced on February 26, 2025, at 3:00 PM.
