The Head of the Special Prosecution Office against Corruption and Organized Crime (SPAK), Mr. Altin Dumani, in exercising the powers of the Public Commissioner, authorized Mr. Klodjan Braho, serving as Prosecutor at the Special Prosecution Office against Corruption and Organized Crime (also Chair of the Anti-Corruption Section), to represent him before the Appeal Chamber during the judicial review of the appeal against Decision No. 744/2024, of the Independent Qualification Commission, concerning the assessee Mr. Artan Hajredinaj, serving as a judge of the First Instance Court of General Jurisdiction of Tirana.

During the attendance verification, the presiding judge informed that the parties had been notified of their submissions and rebuttals, and were invited to present them during the hearing as well.

The Head of the Anti-Corruption Section at the Special Prosecution Office, Mr. Klodjan Braho, adhering to all the appeal grounds, stated the assessee is found in a situation of inaccurate and insufficient declaration of assets and has failed to prove the contrary of the burden of proof in relation to the proficiency assessment. Referring to seven public denunciations, Mr. Braho requested the Chamber to take the identified shortcomings into account in the overall evaluation of the case and, at the conclusion of the judicial review, to amend decision no. 744/2024, of the Independent Qualification Commission and to dismiss from office the assessee, Mr. Artan Hajredinaj.

The assessee, through his legal representative, contested the findings concerning assets and the assessment of proficiency competencies, deeming them unfounded, and in support of his objections, submitted new evidence to the Chamber.

The parties also presented their positions regarding a complained filed to the Chamber. The representative of the Special Prosecution Office stated that the matter raised is still under review by the assessee and therefore has no bearing on the proceedings. The assessee submitted a written response on the matter, accompanied by additional documentation.

Following deliberation, the adjudicating panel decided not to investigate the aforementioned complaint and informed the parties that the documents submitted by the assessee are accepted as evidence. The parties were then invited to present their closing arguments at the hearing scheduled for April 28, 2025, at 14:00.
