The Public Commissioner was present today at the Appeal Chamber while initiated the judicial review of the appeal filed against the Decision no. 255/2020, of the Independent Qualification Commission, of the assessee Mr. Ludovik Dodaj, prosecutor at the Prosecution Office of the Appeal Court, Durrës.
Whereas verifying the presence of the parties in the hearing, the presiding judge informed that the Public Commissioner and the assessee were notified on the acts forwarded by the First Instance Court Durrës, and in appropriate circumstances when the parties did not express other procedural requests, announced that the adjudication panel on the spot consultation, decided to close the judicial review so for to proceed with final conclusions presentation.
The Public Commissioner in his position regarding the evidence filed in the previous hearing stated that the assessee is found the conditions of inaccurate and insufficient declaration of the asset assessment control criterion. Referring to the acts forwarded by the First Instance Court Durrës, the Public Commissioner assessed that it did not appear at any point that the assessee had represented the charges during the trial of that criminal case and its investigatory stages. At the end of the final conclusions, sustaining the appeal grounds, the Public Commissioner requested from the Chamber the amendment of the decision no. 255/2020 of the Independent Qualification Commission and the dismissal from office of the assessee, Mr. Ludovik Dodaj.
The legal representative of the assessee claimed the opposite of the final inquiries of the Public Commissioner and asked the panel to uphold the decision of the Independent Qualification Commission and the confirmation in office.
The adjudication panel after hearing the final conclusions of the respective parties withdrew to the deliberation room, to settle the final decision, which will be announced on July 14, 2022, at 13:30 p.m.
