The Head of the Special Prosecution Against Corruption and Organized Crime (SPAK), Mr. Altin Dumani, in exercising the powers of the Public Commissioner, was present today at the Appeal Chamber, to proceed with the judicial review of the appeal against decision no. 754/2024, of the Independent Qualification Commission, concerning the assessee, Ms. Mirela Mishgjoni, serving as a judge at the First Instance Court of General Jurisdiction of Vlora.
During the attendance verification, the presiding judge invited the parties to present their final arguments.
The Head of the Special Prosecution Office, adhering to the appeal grounds and the arguments presented during the judicial review, deemed that the assessee failed to disprove the appeal grounds related to the asset assessment criterion. He argued that the identified circumstances place the assessee in a position of inaccurate and insufficient declaration of asset, as well as a conflict of interest. Concluding his final arguments, the Head of the Special Prosecution Office requested the Appeal Chamber to amend Decision No. 754/2024, of the Independent Qualification Commission and dismiss from office the assessee, Ms. Mirela Mishgjoni.
The assessee opposed the arguments of the Head of the Special Prosecution Office, stating that both her income and that of her related person were lawfully acquired and that she was neither in a situation of inaccurate asset declaration nor in a conflict of interest. She requested confirmation in office, claiming that the dismissal measure would be inconsistent with the principles of objectivity and proportionality.
After considering the parties’ positions, the adjudicating panel withdrew for deliberation and ruled the final decision to be announced on April 3, 2025, at 9:30 AM.
